The St. Clair County Health Department is charged with accepting and investigating all reports of violations of Michigan's Smoke-free Law by county establishments covered by the law. Residents are encouraged to complete a Smoke-free Law Violation Complaint Form which can be downloaded at www.stclaircounty.org/offices/health or picked up at the department's main office at 28th and Moak in Port Huron. Complaints can also be taken over the phone.
A protocol has been established for investigation of all complaints, which includes phone calls, letters, site visits and eventually a hearing if compliance has not been achieved.
Health Department policy dictates complaints cannot be filed anonymously. A name and contact information (phone number or address) is required for the complaint to be filed and investigated by Health Department staff. Contact information is necessary in case the department requires additional information, as well as documenting that the complainant is committed to making an accurate and credible report of non-compliance. However, this does not mean that the establishment against which the complaint is being made will have access to the identity of the complainant. Even if a Freedom of Information request is filed with the Health Department, the identity of the complainant will be protected. Citizens are encouraged to report smoking violations because it is the most effective and expedient way to enforce the law. It is also the right thing to do to protect our health, as well as the health of our families and our community.
